Durham Driver Amnesty Program

The Durham County District Attorney’s office and the Bloomberg-funded Durham Innovation Team partnered to create the Durham Driver Amnesty Program. In its pilot phase, the District Attorney dismissed 2,500 pending charges for eligible participants which kept them from obtaining their driver’s license.

Velia Duenas, a homeless, married mother of two children, had her license suspended because she was unable to pay $1088 for three juvenile citations. She continued to drive, received three misdemeanor convictions, and spent 141 days in jail because she was unable to pay the fines.

Commonwealth v. Smetana

Appellant was held in contempt and incarcerated for failure to pay his court fines and fees without any inquiry into his ability to pay. The appellant mentioned that his sibling may be able to pay, but no further inquiry was made by the court. He was sentenced to thirty days imprisonment with credit for time served and a $200 fee to purge the contempt.

Personal Narrative: Demetrice Moore

Demetrice Moore is a certified nursing assistant and mother of two children. In 2002, she was convicted of grand larceny, and sentenced to jail and to pay court costs, including the cost of the lawyer appointed to represent her because she was indigent. She served her jail time, but was unable to pay the court costs she owed, which resulted in the automatic suspension of her Virginia driver’s license.
